The term Equitable Distribution of marital property both real and personal property under Pennsylvania Divorce Law does not always mean equal distribution of property between spouses in a divorce related context. The Courts will sometimes distribute property and give to one spouse a greater percentage than the other based on factors including but not limited to, such as earning capacity, earning potential, educational level, contributions towards the acquirement of the underlying property by one spouse, whether one spouse has a physical disability, the age of the spouses etc. Therefore, one spouse may receive less than 50% percent of the value of the assets and this may be deemed equitable under the circumstances but understandably and mathematically not equal.
