Martial Fault cannot be utilized as a legal argument to gain a greater percentage of marital assets during a divorce. Although marital fault can be utilized to prevent a spouse from collecting spousal support and/or alimony it is not legally recognized in the State of Pennsylvania as a viable legal argument to gain an advantage in the equitable distribution of marital assets both real and personal.
